1. General

The Iluka provides its services to you at its website at theiluka.com.au (“Website”) subject to the terms set out in these Terms and Conditions (“this Agreement”). This Agreement forms part of and should be read in conjunction with the The Iluka “Privacy Policy” and Reservation Form found on this Website.

By using the Website you agree, without limitation or qualification to all of the terms set out in this Agreement, the Reservation Form and the Privacy Policy.

The Iluka reserves the right to change from time to time any of the terms in this Agreement by general notice on the Website, and by using the Website you agree in advance to accept such changes. This Agreement may not be otherwise amended.

1a. Dress Code

The Iluka Dress code comes into effect at 5:00 pm every day, including public holidays. 

After this time patrons are not permitted to wear hats of any kind except for religious or medical reasons, tracksuit pants and workwear will also not be permitted (specifically this includes high visibility clothing).

1b. Service

All persons attending the venue must be able to provide adequate identification or proof of age on request at any time. A current passport, Western Australian proof of age card or Australian drivers licence is the only acceptable form of identification in Western Australia.

All minor must arrive with and remain in the company of their own parents or legal guardians at all times. Any breach of this will result in the conclusion of the function.

1c. Events Beyond Control

The Iluka is not responsible for any loss arising out of any occurrences or conditions beyond its control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule.

All travel documents, observance of laws and government regulations are your responsibility.

2. Deals & Promotions

The Iluka may make information regarding Promotions available on this Website. The Promotions are subject to any specific terms and conditions set out in each Promotion in addition to the terms and conditions set out in this Agreement. The Iluka reserves the right to change, modify or withdraw any Promotion at any time.

All deals, offers and promotions are subject to change without notice and are applicable during regular hours only and are excluded during public holidays, extremely busy periods or key calendar events.

2b. Happy Hour

Except public holidays, key calendar dates and public holiday weekends inc. Sundays before public holiday Mondays and 24th Dec.

Happy hour is only available during the advertised hours. No cocktails, no doubles, no bottles of wine, no champagne, no double parking.

The Happy Hour promotion is not available with other promotion.

2b. Gift Vouchers

Gift Vouchers are not refundable or redeemable for cash, these Gift Vouchers are valid for 6 months from the date of issue. Additional values cannot be added to an existing Gift Voucher; however, additional Gift Cards can be purchased. Gift Vouchers are to be treated like cash and if they are defaced, mutilated, altered, lost or stolen they will not be replaced, refunded or redeemed.

The Iluka does not accept any responsibility for lost or stolen Gift Vouchers. No monetary refunds available for gift vouchers redeemed or unredeemed.

4. Social Media

When you post and/or tag any social media content (including, without limitation, photos, text, graphics, audio, video, location information, comments or any other materials) in relation to The Iluka Bar & Café on any social media sites (such as Instagram or Facebook), we may request your permission to use this content in connection with our business. Such use may be in conjunction with our website, electronic media and/or print material.

By accepting our request, you give us and our affiliated companies a worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable, sub-licensable right to use the Social Content in any form and lawful manner for any commercial purposes including (without limitation) online and offline marketing activities.

4a. Competitions

To enter, the user must like The Iluka Facebook or Instagram page and share the relevant post.

The winner will be announced on Facebook approximately a month after the competition announcement date unless they wish to remain anonymous.

Management reserves the right to announce competition winners earlier or later than 30 days from competition commencement.

The winner must claim their prize within one month of the winner being announced. Competition participants must be +18 (21+ for hotel competitions) and be available to come to pick up their prize in person.

No prize is available for refund, exchange or credit. Valid photo ID is required on arrival. Not to be used in conjunction with any other offer.

If a prize includes hotel stay the guest must follow all hotel terms and conditions. The hotel stay may not be on the same date as another part of the prize due to availability.

5. Food & Dining

5b. Reservations & Functions

Reserved tables or sections will only be held for 20 minutes after the booking time has elapsed. By purchasing items via this (or associate) forms we are unfortunately cannot offer refunds.

– Our business has held a section for your event and most likely refused other guests in this space and may have ordered or prepared food for your booking. However, should you wish to postpone your booking or request a change of date, we would be happy to accommodate or even issue you a voucher to the value of your booking for you to utilise at a later date.

5c. Food & Allergies

We do our best to accommodate allergy sufferers and nutritional information can be found on the menu. Please be aware that we use a range of fresh ingredients in our kitchen and we cannot guarantee that dishes will be entirely free from any ingredient.

Not all ingredients are listed with every dish so please ensure you inform the wait staff you have any intolerances. In peak periods we may not be able to change dishes or substitute items to ensure wait times are kept to a minimum and to enhance the dining experience for our guests.

– We thought you might like to know that the food available at The Iluka is made fresh without the use of additives, chemicals, preservatives or flavour enhancers. We combine beef mince with herbs and spices to make our burgers, we make all of our sauces, drizzles, dressings and marinades from fresh herbs and spices. All of our cakes and desserts are baked here daily. The crab, mussels, barramundi & salmon are portioned from real fresh fish daily and never frozen or imported from cheap foreign farms. We use Black Angus beef fillet in our steak sandwiches, our prosciutto, salami, ham and cheese is sliced here daily from quality produce.

Our smoothies are made from real fruit and grains, our milkshakes are made with jams, coulis and sauces that we make here, chemical-free. Your children will eat real chicken, homemade nap sauce, fresh fruit, real fish, homemade chips, homemade tomato sauce, homemade burgers and chemical-free smoothies and milkshakes. The Iluka is a local private company employing over a hundred people. We always endeavour to hire employees and contractors that live within the immediate community.

As the The Iluka has no control over the linked website, you acknowledge that the The Iluka is not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with reliance on such information or material contained on the linked website.

The material used and displayed on the Website for the provision of the Service including but not limited to text, software, photographs, graphics, illustrations and artwork of video, music, sound and names, logos/trademarks are the property of the The Iluka or its licensors and are protected under copyright and other laws and you agree not to use such materials without the The Iluka prior written consent.
